This course will give you an insight into common causes of overpayments and whether you have the right to recover the overpayment with or without the employee’s permission.
Who is this course aimed at?
Team leaders, supervisors and managers within payroll or HR who are responsible for calculating overpayments and recovering them from an employee’s pay.
What will I learn?
This workshop explains the legal and practical implications of recovering overpayments and gives clear guidance to help employers minimise disputes and avoid the risk of court or employment tribunal action.
The rights of employers under the Employment Rights Act 1996 are fully explained and current case law on the subject is also discussed. Written-off overpayments will be reviewed, as well as when to pursue recovery, the tax and National Insurance contribution (NICs) implications of recovery, and the use of ‘de minimis’ limits.
